McCoy 6 owners file suit against City

The owners of McCoy 6 Apartments, LLC, which owns The Augusta on the Square and several other housing complexes in Morgantown, filed suit against several city officials Monday.

The suit, filed in United States Bankruptcy Court for the Northern District of West Virginia, names City Manager Dan Boroff, former Fire Chief Dave Fetty, City Engineer Terry Hough, three code enforcement officers and four fire marshals as defendants.

In the suit, the owners of McCoy 6 and the Augusta allege city municipal officials "have engaged in a conscience-shocking pattern and practice of harassment, intimidation, retaliation and punishment of the Defendants intended to injure them financially by depriving them of their property without just compensation or due process of law."

They cite "repetitious and excessive" Fire and Building Code inspections, "vague and arbitrary" violation citations and "harsh, unnecessary and unreasonable" orders from officials, among other things.

The plaintiffs assert they acted properly, trying to comply with the city's demands at each of their properties.

Their claims surround demands they call "unreasonable and unprecedented" made by the city as they tried to construct The Augusta on the Square in 2007.

According to the suit, the City's Building Code Enforcement and Fire Department "adopted and initiated an improper and unlawful pattern and practice of retaliation against the Plaintiffs that involved harassing Augusta development and project personnel," delaying completion of the apartments and increasing the cost of the development by more than $500,000.

When the Augusta was completed in a timely manner, city officials were angered and embarrassed, the owners claim, because they had publicly expressed doubts it would be completed.

Officials then "engaged in a concerted pattern and practice of harassment" by making extreme demands of McCoy 6 at its Mountaineer Court Apartments.

The property was condemned twice in 2008, though McCoy 6 maintains this was unwarranted, and ownership of the property was taken from McCoy 6, resulting in a $2 million loss.

The plaintiffs are seeking monetary compensation and relief from the city's inspection procedures, which they believe are excessive.

"Every one of the accusations can be backed up with lots of information," but would not comment further said McCoy 6 co-owner Kris Warner.

Boroff refused comment on the matter.

Nice to see some things never change-the Warners were slum lords when I was at WVU in the early 90s. I can't imagine anyone renting from them.

I remember when this first came about and the city was wetting their pants to be involved. Turns out it was just the beginning of the end for sunnyside.

Anyone who believes what a developer says deserves exactly what they get. Sadly, the Dominion Post is only too happy to trumpet the PR happy talk and reprint the pretty pictures.

Mccoy 6 properties are definitely sub par to say the least. Everyone looks at the house before you sign the lease. If you don't want to live there you don't sign the lease. Every time we've had a problem with our property its been only a few days to get it fixed. If you are polite they work with you.
Regardless, I do believe the owners of Mccoy 6 are greedy and selfish and I would never live in one of their properties again. But, its a crappy house in Morgantown. I got what I signed up for.

Beyond the long history of problems with the apartments, let's not forget the Square at Falling Run debacle. The Square was supposed to be a large, urban-style development with residential and retail. It was announced before many other retail (University Town Center, Suncrest Town Center) and residential developments. Here we are, 7 or 8 years later. All of these other properties are complete. But The Square is still just the Augusta and a bunch of empty land. The community was spun from the very beginning, in my opinion. Everyone should have realized that their history was in low-end apartments, not high-end developments.

Also, it's pretty funny that these conservative politicians (a former GOP party chair, former gubernatorial candidate and a current congressional candidate) needed government action to try to build their development in the first place and have resorted to a lawsuit to try to make some money when the business failed. What happened to "small government" and "tort reform?"

WVU really needs to do more with off campus housing. No doubt McCoy6 is the worst of the worst. But there are others that need to be cleaned up along with them. Ask just about anybody and they say to stay away from McCoy 6 houses. Finding a decent place for a fair price is almost impossible. They are too expensive and nice. Or they are too expensive and slum junk like McCoy6. Finding mid-level off campus is tough. It is time for WVU to stand up and do something about off campus housing.

Sadly these "brothers" are out for one thing....to line there own pockets! I worked for them and watched one shady deal after another. slum lord doesn't even begin to describe it. Sadly, they will waste tax payer money by filing this suit in the hopes of getting something they haven't earned. If they ran upstanding businesses it wouldn't be an issue. Hopefully, when the lose, we can finally rid the community of these people! Morgantown needs good business men...not crooks!

What goes around comes around. McCoy 6 was able to fly under the radar running the slums before. Now, with these larger scale and more visible projects their corrupt practices are coming to light.

They've treated the residents and students like trash for the 10 years that I've known them. While I can generally find fault with the City, its officers and employees quite easily, I must pat them on the back for this.

Cry all you want McCoy 6, you've burned too many people in Morgantown for anyone to care.

Our kitchen floor started sinking and Mcoy never even came to look at it. My roomates and I called several times. They will never call you back. Their office people are very rude when you call. We then reported it to the city and WVU student legal service.

McCoy 6 are slumloards,maybe they're trying to get money for all the security deposits they used for themselves and not on its residents.

The Augusta is the biggest waste of space as well.

The fire marshall is scum. He fines everone he gets a chance to and can't do a thing if the fines are unpaid. He followed some friends of mine home tring to pick a fight.

Hey anonymous - you firing from the hip on corruption and bribes or actually know something?
Warners have been slumlords as long as I've been in Morgantown (22 years).
They are just upset that they are going to lose their TIF district as they haven't been able to convince reasonable people to finance their project within the time period allowed by their agreement.
Also, Mark Warner needs an excuse for why his business is in bankruptcy while he runs for public office.
So, think before you post.

Morgantown is filled with corruption that is ruining the city. Pay the bribes and you can do whatever you want. Stand up for you're rights and they'll shut you down.
