Six SGA election violations pending

West Virginia University's Student Government Association will delay changing leadership positions one week after election results failed to be certified Tuesday night.

The SGA Judicial Board met Tuesday along with SGA Attorney General James Bailey and SGA Elections Chair Matt Gutta, to discuss six reported election violations.

The Board will release a statement today regarding the six cases after hearing the defendants at the meeting.

The four defendants present were PIRATE Party Athletic Council-elect Jarred Zuccari, Governor-elect Olivia Audia, Governor-elect Evan Bonnstetter and Mountaineer Choice Governor candidate Matthew Boczanowski.

The other two candidates could not attend the meeting due to scheduling conflicts.

Bailey first presented Zuccari's case. Gutta filed a violation after Zuccari sent out a group initiation through Gutta's Facebook. Zuccari said it was an "unintentional mistake."

Gutta said he allowed Zuccari on his Facebook, and believed there were no malicious intentions.

"If he would've known that sending group invites from the elections chair Facebook was a violation at the time he definitely wouldn't have done it," Gutta said. "He's definitely competent enough."

The Board resolved the issue within 20 minutes by incorporating the "Rock the vote" campaign. Gutta sent page requests for all candidates in the election. It affected approximately 80 people, Bailey said.

Audia was accused of dorm storming, a violation filed by members of the Mountaineer Choice who submitted a picture of her in Honors Hall.

She said she was meeting with Bonnstetter to go campaigning. Citing her Adventure West Virginia leadership this summer, Audia said she was talking to students she knew when the picture was taken.

She said she was not campaigning, though her campaign materials were in a bag she was carrying.

"I was not wearing my shirt, so it wasn't, like, easily accessible, and I wasn't handing them out," she said.

The violation filed against Bonnstetter was similar to Audia's – dorm storming in Honors Hall. Bonnstetter, however, lives in the residence hall.

Bonnstetter said he was talking to his friends, encouraging them to vote but not saying whom to vote for.

"A lot of kids in the Honors Hall didn't know about elections, we didn't have a bulletin board with posters," he said. "There's a couple signs on doors."

The individual Bonnstetter was talking to wrote a letter to the Judicial Board detailing the conversation.

Boczanowski had a violation filed against him for having e-mails sent out on a University listserv endorsing him.

After presenting a letter from the individual who sent the e-mail, which states a University listserv was not used, Boczanowski had a copy of the received e-mails – all MIX and Gmail addresses, legal by the Elections Code.

Bailey said the e-mail affected approximately 40 people.

The other candidates will meet the Judicial Board later in the week.

Elections Chair Gutta supposedly filed the complaint against Jarred Zuccari - I don't think so - Gutta cleared Zuccari at the SGA Judicial Board sounds like another Peters drama moment to me.

I am one of those 'non-readitional' students here at WVU, and in my tenure here I have never once seen the SGA do anything to make us feel welcome here or we belong. Never once. All they care about are the 'traditional' students, or so it seems.

And since when were we non-trad's and trad's anyway? I thought we were all Mountaineers...?

Whitney Peters stirs the pot more than anyone in SGA. i'm a governor and she brings me into her office and tells me how everyones out to get me then tells other people the same, she loves drama and we've all gfinally caught on... if u think hard enough shes behind all the drama.

unfortunately, only those persons who have violations against them can be prosecuted. Let's hope the Judicial Board makes an example out of these individuals so as to curb future issues.

lets keep in mind people Molly Casto was the person last year cheating on her Iphone. Why wouldn't she cheat this year? Jasmine going through the frat houses and making people vote for her and suprisingly she didn't win with all of her dorm storming. If they want to get people caught dormstorming and have legitimate evidence maybe they should make an election committee that sits in the dorms during the times of elections or maybe the RA's should be doing their job since they get other benefits for having the job as an RA. And as for Ian, He is a selfish jealous person who is trying to take pity and make people look bad who have succeeded over him. Anyone who would have ran would have beaten him. I just think its funny when he is pointing his finger at someone who has "cheated" while he himself and his ticket has too.

If you actually read the story- Ian didn't file the complaint against Jared- The election's chair did. TO me, that says something. Not just trying to point fingers... maybe he should be dq'd

Yes- the decision will show how above the law sga is. It's ironic that sga chooses the Judicial Board. But what do you expect, you're put in a position by Jason Zuccari, of course you're going to protect his brother.

To me, I don't see why the number of votes is relevant. It's really not even relevant that he won (although I doubt any complaint would have been filed). The fact is that he cheated. Knowingly or not (although c'mon, you expect me to believe he thought it was perfectly okay to use the elections chair's facebook to gain supports) it is still wrong. But of course, his last name is Zuccarri--- so you know SGA will make this go away. They always "protect their own".

He won by 300 votes and almost had more votes than MC he we went to every club sport meeting he could find. Get over it, they aren't going to dq him they might fine him. This is all just Whitney and Ian trying to waste ppls time. Ian filed all the complaints Monday just be a soar crying looser because this hurt his ego. If he would of spent as much time campaigning as he is filing complaints he might of won.

And furthermore-- 80 votes isn't just 80 votes... That's 80 votes another candidate didn't get (-80) plus the 80 votes Jarred got. That's a 160 vote swing. Intentional or not, it's wrong. I hope the J-Boards doesn't pay him any favors because of who his brother is.

I have to agree with the person who posted below me. First, there's no way you can say if only affected 80 people. Do those 80 people not have friends? I know for this election I asked my friends who to vote for for some positions. And cheating is cheating. Also, shouldn't a candidate win an election on his or her own merits? If you've got the elections chairs out there getting votes for everyone, that hardly seems fair. I didn't know about any of this. IMO Jarred should be required to forfeit because that certainly skewed the results in his favor.

Does it really matter how many people Zucarri's facebook incident affected? Cheating is cheating. Or is it the case that as long as you can "prove" the cheating didn't effect the outcome of the election, then it's okay? That does not seem reasonable. It's a slippery slope, but the defense they are trying to use..

From my reading, it is my understanding that those snapping the pictures were not the friends to whom the candidates were speaking.

Isn't Zuccarri's facebook incident clearly illegal? it doesn't matter if he knew it wasn't wrong, he still did it. Out of everyone his defense looks the weakest.
